ALAS Calls FirstEnergy Ruling Threat to Privilege

A recent Law360 article mentioned an amicus brief filed by ALAS, the U.S. Chamber of Commerce, and the Ohio Chamber of Commerce supporting FirstEnergy’s petition for a writ of mandamus from the Sixth Circuit reversing lower court rulings allowing plaintiffs’ lawyers investors’ access to internal investigative documents produced by two Am Law 200 firms after a $1 billion bribery scandal became public.  The amicus brief argued that the lower court decisions “ignored the legal purposes of internal investigations and threatens [attorney-client privilege’s] very existence in the corporate context.”
